Outdoor Burning
Burning in Whatcom County is regulated by the International Fire Code and Washington Administrative Codes relative to air pollution requirements.
General Fire Rules
- All fires must be attended by someone at least 16 year old
- Only burn natural vegetation grown on that property
- No burn barrels allowed anywhere at any time
- No burning at any commercial business
- No burning of household garbage
- No burning of paper or cardboard (except to start a fire)
- No burning when winds exceed 7 miles per hour
- No construction debris / milled lumber of any kind
- Must have landowner permission to light all fires

NOTE: If your property lies within the boundaries of Whatcom County Fire District 5 (Point Roberts), District 11 (Lummi Island) or District 17 (Sandy Point), you must contact those fire districts for information on outdoor burning regulations and to obtain permits to burn.

The Whatcom County Fire Marshal's Office partners with the Northwest Clean Air Agency to educate and enforce the outdoor burning rules and laws for Whatcom County.
In the State of Washington, "...It is unlawful for any person to cause or allow outdoor burning that causes an emission of smoke or any other air contaminant that is detrimental to the health, safety or welfare of any person, that causes damage to property or business, or that causes a nuisance." (WAC 173-425-050 (4))
A nuisance is defined as: "an emission of smoke or any other air contaminant that unreasonably interferes with the use and enjoyment of the property upon which it is deposited." (WAC 173-425-030 (14))
Any fire that is deemed a nuisance or is a fire/life safety hazard may be extinguished by the fire department, under authority of the International Fire Code, adopted by Washington State and Whatcom County.
If you have an outdoor burning complaint that is currently occurring in unincorporated Whatcom County, please dial 911 and report an outdoor burning violation due to a nuisance or fire hazard. You may also choose to follow up with a fire inspector during normal business hours at (360) 778-5900.
If you have an outdoor burning complaint that is not actively occurring, but is located in unincorporated Whatcom County, please contact the Fire Marshal's Office during normal business hours at (360) 778-5900 to speak with a fire inspector about methods to remedy the situation.
*NOTE: If you have a smoke complaint originating from an indoor appliance, such as a wood stove or fireplace, please contact the Northwest Clean Air Agency directly at (360) 428-1617.
There is a permanent burn ban in effect within certain city limits and urban growth areas (UGAs). Recreational Fires are still allowed in the UGAs. The areas with permanent burn bans are:
- City of Bellingham and surrounding UGAs
- City of Sumas and surrounding UGAs
- City of Lynden and surrounding UGAs
- Cities of Everson and Nooksack and surrounding UGAs
- City of Ferndale and surrounding UGAs
- City of Blaine and surrounding UGAs
- Urban Growth Area of Cherry Point
- Urban Growth Area of Columbia Valley
- Urban Growth Area of Birch Bay
Please click the links above to view a map of each city or Urban Growth Area that has a permanent burn ban. If the property where the fire is to be located is within on of these areas, you can ONLY have a recreational fire. If you are outside of these areas, please go to the burn permit rules page for more information on how to obtain a permit to burn yard debris or land-clearing debris
