Fireworks

The County Fire Marshal’s Office is primarily responsible for the permitting and regulation of commercial fireworks displays and the retail sales of fireworks. During the 4th of July holiday period our inspectors also assist the Sheriff’s Office in the enforcement of fireworks discharge regulations.

Consumer Firework Usage

Allowed Day & Times

In 2015, The Whatcom County Council created an ordinance to limit the dates consumer fireworks can be discharged in unincorporated areas. Please note these new dates and times below:

  • July 3: 6:00 PM - 11:00 PM
  • July 4: 6:00 PM - Midnight
  • July 5: 6:00 PM - 11:00 PM
  • December 31: 6:00 PM - 1:00 AM

Legal Fireworks

Consumer fireworks sold at a Washington State Licensed and Whatcom County Permitted stand are allowed to be used in the county. The Washington State Patrol has a list of legal and illegal fireworks  on their website.

Sky Lanterns - Sky lanterns are now allowed in Washington State when tethered (i.e. kite string or similar material).  The tether must remain attached for the full duration of flight and the lantern material must be recovered and disposed of properly.  Any fire started with a sky lantern (tethered or not) is subject to Reckless Burning laws and fire code violations which can amount to both civil fines and criminal charges.

Legal Tribal Land Fireworks

 Firecrackers, bottle rockets, missiles, and rockets are legal to possess and discharge on tribal lands ONLY. These items are illegal in Washington State and become illegal fireworks when possessed off tribal lands.

Illegal Fireworks and Improvised Explosive Devices

 M-80’s and larger, dynamite and any improvised, homemade or altered explosive devices such as tennis balls or cherry bombs are illegal explosive devices. Persons in possession or using illegal explosive devices can be charged with a felony.

Fireworks sales and discharge laws differ in each incorporated city in Whatcom County. This list developed by Washington State Patrol shows Whatcom County County/City information regarding Fireworks usage.  For specific questions, please contact each respective city's fire official for information on fireworks within those jurisdictions.
